Terms of Service

Welcome to Clinch ("Platform", "we", "us"). By creating an account or participating in any competition, you agree to these Terms of Service. Please read them carefully before signing up.

1. What We Are

Clinch is a skill-based competition platform. Participants pay a fixed entry fee and complete a precision challenge. The participant with the highest precision score wins the prize. This is not gambling — outcomes are determined by skill and reaction time, not chance.

2. Eligibility

To participate you must be: (a) at least 18 years of age; (b) a resident of a country listed as an eligible shipping destination for the specific competition; (c) acting on your own behalf, not on behalf of a business entity.

We reserve the right to verify your identity before delivering any prize. Providing false information will result in disqualification and account termination.

3. How Competitions Work

Each competition has a fixed entry price, a minimum number of entries required to close, and a target number of entries. Competitions open with no fixed end time and fill up as participants enter. Once paid entries reach 90% of the target, a 48-hour closing countdown automatically begins. The competition closes when that countdown ends or when the target is reached, whichever happens first.

The winner is the participant with the highest precision score. In the event of a tied score, reaction time is used as a tiebreaker.

If a competition closes without reaching its minimum entry threshold, all paid entries are eligible for a full refund (see Section 5 — Refund Policy for timelines and process).

4. Payments

All payments are processed securely by VIVA Wallet, a licensed European payment institution. Clinch does not store your card details. Entry fees are non-refundable except in the circumstances described in Section 5 (Refund Policy).

5. Refund Policy

Entry fees are generally non-refundable. Refunds are issued only in the following circumstances:

a) Competition cancelled due to insufficient entries. If a competition closes without reaching its minimum entry threshold, every participant who paid receives a full refund automatically — no action is needed on your part. We will send a confirmation email when the refund is initiated.

b) Verified platform error. If a verifiable technical error on our side prevented you from completing your precision attempt after your payment was confirmed, you may request a refund within 7 days of the payment date. We will investigate and, if the error is confirmed, issue a full refund.

When refunds are not available: Refunds are not issued because you changed your mind, did not win the competition, were dissatisfied with the result, failed to claim your prize within the 30-day window, or provided an incorrect delivery address.

How to request a refund. Email us at support.makeawish@gmail.com with your registered email address, the name of the competition or its ID, and a brief description of the issue. We aim to respond within 48 hours and resolve all eligible requests within 10 business days of approval.

Processing time. Approved refunds are credited to the original payment method (card or bank account) used at checkout. After we initiate the refund, your bank or card provider may take an additional 5–10 business days to reflect the amount in your account — this is outside our control.

6. Prize Delivery

Winners are notified by email and must submit a delivery address within 30 days. Prizes are physical products shipped to the address provided. We are not responsible for delays caused by customs, courier services, or incorrect addresses provided by the winner.

Taxes on prizes:The winner is solely responsible for any taxes, duties, or levies applicable to the prize under the laws of their country of residence (including but not limited to prize tax or income tax on winnings). Clinch does not withhold or remit any such taxes on the winner's behalf.

7. Fair Play

Each account may enter any competition only once. Creating multiple accounts to gain additional entries, using automated tools, or attempting to manipulate results in any way will result in immediate disqualification, account termination, and forfeiture of all entry fees.

8. Intellectual Property

All content on the Platform — including text, design, logos, and graphics — is owned by Clinch or its licensors. You may not copy, reproduce, or distribute any content without our written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Clinch is not liable for indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability in connection with any competition shall not exceed the entry fee you paid for that competition.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. Continued use of the Platform after changes are published constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Greece. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Greece.
